Regulations on Inventions
The IISGM has an Innovation Guide approved by the Innovation Committee in June 2024. This guide aims to establish a framework governing:
- Ownership of the results arising from research, development and innovation activities, hereinafter R&D&I, carried out within the Institute;
- The procedures to be followed for protecting the aforementioned results;
- The distribution of benefits and costs arising from their exploitation.
A summary is presented below as a basic guide to action
Ownership of the results of research activity
Ownership, as well as the exploitation rights relating to inventions arising from R&D&I results, belongs to FIBHGM (in accordance with Law 24/2015 of 24 July on Patents (LP), Title IV). In cases where the authorship of an invention includes staff belonging to other institutions, ownership and the corresponding exploitation rights shall be established on a case-by-case basis.
Exploitation rights relating to works created within the framework of Intellectual Property shall belong to their authors, who may assign them to FIBHGM, under the terms and to the extent provided for in intellectual property legislation
Distribution of benefits from the results of research activity
If FIBHGM assumes the expenses inherent in protecting R&D&I results via Industrial or Intellectual Property (software only), once income derived from the project begins to be generated, this income will initially be allocated to covering the expenses incurred by FIBHGM, unless otherwise agreed by the innovation committee for justified reasons. Once these expenses have been covered, the exploitation profits, once collected by FIBHGM, will be distributed according to the table:
*In any of the arrangements, the inventors/authors may decide to reduce their individual percentage share of the exploitation profits in favour of the research group, in which case FIBHGM will also waive the same amount in favour of the research group.
Industrial Property and Intellectual Property (software registrations only)
| Institute | Research group | Inventor/Author | |
| Protection costs assumed by FIBHGM | 33% | 33% | 33% |
|---|---|---|---|
| Protection costs assumed by the research group | 20% | 47% | 33% |
Intellectual Property
(except software registrations)
| Institute | Authors | |
| Protection costs assumed by FIBHGM | 30% | 70% |
Moral rights of authorship of research staff
FIBHGM will in all cases respect the right of research staff to be recognised as the inventor or author of the inventions or works they have developed.
Innovation Funding
In cases where the innovation committee issues a favourable report on the protection of industrial property, the FIBHGM will generally fund the application (Spanish or European) and maintenance of the priority patent or priority utility model during the first five years, i.e. up to and including the 5th year.
